OUR SERVICES
We offer art-related activities, which may include art classes, workshops, painting events and private events. Available activities, dates, locations, inclusions and prices are described on our website or communicated when you enquire or book. Activities are subject to availability. Any minimum participant numbers, age restrictions or other requirements will be communicated before you complete your booking.
BOOKINGS
Bookings may be made through our website or by contacting us, depending on the activity. Please provide accurate contact and booking information. If you book on behalf of another person, please share the relevant activity details and these terms with them. A booking is confirmed when we send a confirmation or otherwise confirm it in writing. An enquiry alone does not guarantee a place.
PRICES AND PAYMENT
Prices are in Australian dollars (AUD). Applicable taxes and compulsory charges will be included in the price or clearly disclosed before you complete your booking. Payment arrangements, including any deposit or balance due, will be stated when you book or in your quote. Where full payment is required in advance, your place is confirmed once we receive the required payment and confirm your booking. For private events, the price, inclusions and payment schedule will be provided in a quote or booking confirmation.
YOUR CANCELLATION OR CHANGE OF BOOKING
If you need to cancel or change a booking, please contact us as soon as possible. For public classes and workshops, when you change your mind or cannot attend:
• At least 48 hours before the scheduled start: you may choose a refund or request a transfer to another available session.
• Less than 48 hours before the scheduled start, or if you do not attend: a refund is not generally available. You may ask about a transfer; transfers are subject to availability and our agreement.
You may transfer your place to another suitable participant by notifying us before the activity, provided that person meets applicable requirements. Private event cancellation and rescheduling terms will be provided in the quote or booking confirmation before you commit. This section does not limit your rights under the Australian Consumer Law.
CANCELLATIONS OR CHANGES BY US
We may need to cancel or reschedule an activity because of illness, insufficient bookings, unsafe conditions or a venue issue. We will notify you as soon as reasonably possible. If we cancel, you may choose a refund of the amount paid for the cancelled activity or, if available, a transfer or credit. If we make a significant change, such as to the date or location, and you cannot reasonably attend, you may choose a refund for that activity or an available alternative. Your rights under the Australian Consumer Law continue to apply.
AUSTRALIAN CONSUMER LAW
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes rights or remedies that cannot lawfully be excluded, restricted or changed. If a service has a major failure, you may be entitled to cancel it and receive a refund for the unused portion, or to compensation for its reduced value. You may also be entitled to compensation for reasonably foreseeable loss or damage.
If a problem is not a major failure, you may be entitled to have it fixed within a reasonable time. If it is not fixed within a reasonable time, you may be entitled to cancel and receive a refund for the unused portion. Contact us if you have a concern so we can discuss an appropriate remedy.
PARTICIPATION AND SAFETY
Please follow reasonable safety instructions, use materials and equipment as instructed, and treat participants, instructors, equipment and the venue with respect. Tell us before the activity about allergies, sensitivities, accessibility requirements or other conditions that may affect safe participation, so we can discuss suitable arrangements. Art materials may stain clothing or belongings; please wear suitable clothing and take reasonable care of your belongings.
We may ask a participant to stop or leave if their conduct presents a safety risk or seriously disrupts others. We will consider the circumstances, including whether the issue can reasonably be resolved. Any refund or other remedy will be assessed in accordance with the circumstances and applicable law.
CHILDREN AND YOUNG PEOPLE
A parent or legal guardian must make or authorise a booking for a participant under 18 and provide accurate contact details and information relevant to the child’s safe participation. Supervision, drop-off and collection arrangements will be communicated for the activity. A parent or guardian must remain with the child where required for the activity or venue.
MATERIALS AND ARTWORK
The activity description or booking confirmation will state whether materials are included or whether you need to bring your own. Participants may take home their artwork unless otherwise agreed or it needs additional time to dry or be collected. We will communicate collection arrangements. Images of completed artworks are examples; individual results may vary.
PHOTOGRAPHY AND VIDEO
We may wish to take photographs or videos during activities for promotional purposes. We will ask permission before using an identifiable image of you for promotion, or a parent or legal guardian’s permission for a participant under 18. You may decline without affecting participation. You may contact us to withdraw permission; we will explain what we can reasonably do to stop future use. Material already published, shared or printed may not always be retrievable.
INTELLECTUAL PROPERTY
Unless otherwise stated, website content and materials we provide, including text, photographs, artwork, designs and teaching materials, are owned by us or used with permission and are protected by applicable intellectual property laws. You may use them for personal, non-commercial use. You must not reproduce, sell, distribute or commercially use our content without prior written permission, except where permitted by law. You retain any rights you have in artwork you create. We will seek permission where required before commercially using images of your artwork.
WEBSITE USE
You agree to use our website lawfully and not interfere with its operation, introduce harmful material or attempt unauthorised access. We aim to keep information accurate and current, but errors may occur. Contact us to confirm an activity detail before booking. Third-party websites and services are governed by their own terms and privacy policies.
PRIVACY
We collect and handle personal information to respond to enquiries, manage bookings, provide activities and communicate with you. Please contact us privately if you need to discuss sensitive information relevant to safe participation. Further information is available in our Privacy Policy.
LIABILITY
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including your rights under the Australian Consumer Law. Subject to those rights, each party remains responsible for loss or damage caused by their own acts or omissions to the extent required by law.
CHANGES TO THESE TERMS
We may update these terms from time to time and publish the updated version on this page. The terms provided when you make a confirmed booking will generally apply to that booking, unless we agree otherwise or a change is required by law.
GOVERNING LAW
These terms are governed by the laws of Queensland and the applicable laws of Australia.
